How Bail Works in Michigan

If you or a loved one have been taken to jail after an arrest, chances are good that you will need to become familiar with what bail is and how it works. Bail is basically an amount of money that you can give to the court in order to get out of jail while you await the completion of your trial. Not all defendants are given the opportunity to pay bail, however. In fact, some defendants are denied bail altogether, meaning they have to await the completion of their trial from jail. Other defendants are let out of jail on their own recognizance.

When you are given the chance to get out of jail on bail, your bail amount will be based on the crime that you have been accused of committing. All counties throughout Michigan charge the same basic amount for the same crimes. However, bail could vary based on the individual and his or her criminal history.

Bail can be paid by the defendant directly, as long as the defendant has access to financial resources that are large enough to pay the bail amount. However, most of the time, a bail amount is several thousand dollars, which is difficult for many people in Michigan to afford.

When a defendant cannot afford to pay bail, the defendant can either stay in jail until the completion of his or her criminal trial, or the defendant can use the services of a bail bonding agency.
