How Bail Works in Washington State
Bail is a term for the payment that a defendant has to make in exchange for his or her release from jail after having been arrested. Bail is completely refundable to the payee, as long as the defendant fulfills his or her legal obligation to the courts system. In the state of Washington, bail works the same way throughout all of the counties.
Bail in the state of Washington works according to the following steps:
- A defendant is arrested on suspicion of a crime. The defendant is taken to a police station in the Washington county or city in which he or she has been arrested.
- While at the Washington police station, the defendant is booked. Though he or she has been arrested, the defendant is still a suspect, according to United States law. In order to be convicted of a crime, the defendant will have to stand trial.
- Once the defendant is released on bail, the defendant must await his or her trial date.
- The defendant needs to return to court to complete al trial dates and hearings. Once the legal obligation has been completed, the payee of the bail will receive a full refund (less any administrative fees) of the bail amount.
Bail amounts can be rather expensive, depending on the unique circumstance of each case. Across all Washington state counties, the bail amounts are roughly the same for the same offenses. However, because so many people cannot afford to pay the full amount of the bail on their own, many defendants call upon a bail bonding agency for help paying the bails.
