How Bail Works in Michigan
If you or a loved one have been taken to jail after an arrest, chances are good that you will need to become familiar with what bail is and how it works. Bail is basically an amount of money that you can give to the court in order to get out of jail while you await the completion of your trial. Not all defendants are given the opportunity to pay bail, however. In fact, some defendants are denied bail altogether, meaning they have to await the completion of their trial from jail. Other defendants are let out of jail on their own recognizance.
When you are given the chance to get out of jail on bail, your bail amount will be based on the crime that you have been accused of committing. All counties throughout Michigan charge the same basic amount for the same crimes. However, bail could vary based on the individual and his or her criminal history.
Bail can be paid by the defendant directly, as long as the defendant has access to financial resources that are large enough to pay the bail amount. However, most of the time, a bail amount is several thousand dollars, which is difficult for many people in Michigan to afford.
When a defendant cannot afford to pay bail, the defendant can either stay in jail until the completion of his or her criminal trial, or the defendant can use the services of a bail bonding agency.
A bail bonding agency will provide the defendant with the full amount of the bail in exchange for a down payment from the defendant of usually about ten percent of the total cost of the bail. This down payment can be paid by credit card, check, cash, or even collateral in some cases.
As soon as the defendant completes the legal obligation to the courts, the defendant will receive a refund of the bail amount. If the bail bonding agency paid for the bail, then the bail bonding agency will receive the refund. However, if the defendant fails to complete the legal obligation, the payee of the bail will not receive a refund. In such a case, the defendant becomes a fugitive. Bail bondsmen may then hire a bounty hunter to track down the fugitive for rearrest, upon which time the bail bondsman may receive a refund of the bail amount, along with additional collateral from the defendant.
What is Bail?
If you or a loved one has been arrested on suspicion of a crime, you may be able to get out of jail on bail. A bail bond is an amount of money that the courts will charge a defendant in exchange for the defendant's freedom. When the defendant fulfills his or her legal obligation, this bail bond will be refunded to the payee.
Because so many defendants do not have the necessary resources to pay the full amount of the bail, they enlist the services of a bail bonding agency, such as You Walk Bail Bond Agency. The amount of the bail will vary based on the accused crime. However, the bail bonding agency will pay the full amount of this bail bond in exchange for a down payment from the defendant, which is usually about ten percent of the total amount of bail.
