What is bail?

The bail bond is the amount of money that the courts require in exchange for freedom until the end of a trial period. This amount is based on the crime that a defendant has been accused of committing.

How Bail Works in Connecticut
If an individual is arrested in Connecticut, the individual will be taken to jail for booking. Once arrested, the individual becomes a defendant and must go to trial in order to defend his or her innocence or to declare his or her guilt. While awaiting trial, the defendant will be held in jail unless he or she is given the opportunity to get out of jail on bail.
When a defendant is given the chance to get out of jail on bail, the defendant needs to provide the courts with the full amount of the bail. The courts will hold onto this amount of money in the form of a bond until the defendant completes his or her legal obligation to the courts. Once the legal obligation has been completed, the courts will release the bail amount back to the payee of the bail, regardless of whether the defendant is guilty or innocent.
There are many situations in which a defendant is unable to pay for the full amount of the bail on his or her own. After all, bail is usually several thousand dollars and can vary based on the crime that the defendant has been accused of committing and based on the defendant's criminal history.
Defendants that are unable to pay for bail on their own can consult a bail bonding agency for help paying the bail amount. A bail bonding agency will provide the courts with the full amount of money needed for the bail. Once the defendant completes the legal obligation to the courts, the bail bonding agency will receive a refund of the bail amount.
To pay for bail bonding services, the defendant will give the bondsman a ten percent down payment of the total cost of the bail. This down payment is non refundable. Also, the defendant may need to provide a list of assets in case the defendant fails to complete his or her legal obligation and the bail bonding agency needs to cover the cost of the lost bail money.
In some cases, defendants fail to appear in court to complete their legal trials. In such situations, the bail bonding agency will not receive a refund of the bail amount, unless they are able to track the defendant down in order to return him or her to jail. If the bail bonding agencies are able to track the defendant down, the agencies will charge the defendants additional fees and may seize assets that belonged to the defendants, such as a home or
a car.
